What is an Assumption of Risk and Release Agreement?

Assumption of Risk and Release Agreements are used to:

  • Inform prospective participants of potential risks associated with an activity
  • Allow an individual to voluntarily choose to incur the risks
  • Secure an agreement from the individual to indemnify, save, and hold harmless the University

Why are the Assumption of Risk and Release Agreements important?

The University of Arizona sponsors a wide variety of optional travel, recreational, cultural, educational, physical, and other activities for members of the University community and the public. Assumption of Risk and Release Agreements help ensure participants fully understand and appreciate the risks associated with these activities, and serve to mitigate liability risk to the University. Departments are encouraged to carefully evaluate whether Assumption of Risk and Release Agreements should be used in connection with events or activities hosted, sponsored, or affiliated with the department.

When should Assumption of Risk and Release Agreements be used? 

Required

  • When minors are involved
  • Strenuous physical activity or physical activity with significant risk of serious injury

Strongly Recommended

  • Activities with overnight travel
  • Out of town travel

May Be Appropriate

  • Elective or voluntary field trips
  • Low-risk recreational activities
  • Short distance travel

No Agreement Needed

  • Required for class credit
  • An event or activity in which faculty or staff are acting in the course and scope of their University employment (i.e. faculty or staff should not be asked to sign an agreement)
  • Activities with little to no risk of injury

How are the Assumption of Risk and Release Agreements retained? 

Signed agreements are to be maintained by the sponsoring department for 5 years following the completion of the event, per University records retention schedule.
